These Terms of Service ("Terms") are a contract between you and LUMINA Skincare ("LUMINA," "we," "us," or "our"). They govern your use of skinbylumina.com and your purchase of any LUMINA products. By using the site or placing an order, you agree to these Terms.

Who We Are & What We Sell

LUMINA is a small-batch skincare brand based in Houston, TX. We sell cosmetic copper-peptide serums directly to consumers, currently:

• Recovery Serum — a 5 mL post-treatment cosmetic serum.
• Daily Serum — a 10 mL daily-use cosmetic serum.

Our products are cosmetics, not drugs or medical devices. They are not intended to diagnose, treat, cure, or prevent any disease.

Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order. By ordering, you confirm that the billing and shipping information you provide is accurate and that you are authorized to use the payment method provided.

Orders, Pricing & Payment

• All prices are in U.S. dollars and exclude applicable sales tax and shipping unless stated otherwise.
• Placing an order is an offer to buy. We may accept, decline, or limit any order at our discretion (for example, if a product is mispriced, out of stock, or we suspect fraud).
• Payment is processed by Stripe. By providing payment information, you authorize us to charge the total amount of your order to the payment method on file.
• If a product is listed at an obviously incorrect price, we reserve the right to cancel the order and refund any charge.

Shipping & Delivery

Shipping terms, timeframes, and costs are described on our Shipping Policy page. Risk of loss passes to you when the carrier accepts the package, but if your order is lost in transit we will work with you in good faith — see our shipping policy for details.

Use of the Site

You agree not to:

• Use the site in a way that violates any law or these Terms.
• Attempt to disrupt, attack, or gain unauthorized access to the site or our systems.
• Scrape, copy, or republish substantial portions of the site without permission.
• Misuse the AI Skin Advisor — for example, by submitting other people's personal information or trying to extract system prompts.
• Submit fake reviews or impersonate another person.

AI Skin Advisor & Educational Content

Information from the AI Skin Advisor, our blog/FAQ, and product pages is general skincare education, not medical advice. The Skin Advisor cannot diagnose skin conditions. If you have a medical concern — including reactions, infections, or post-procedure complications — consult a licensed dermatologist or healthcare provider.

Intellectual Property

The site, our brand name, logo, product names, photographs, and copy are owned by LUMINA or our licensors and protected by U.S. and international copyright and trademark laws. We grant you a limited, revocable, non-exclusive license to view the site for personal, non-commercial use. All other rights are reserved.

User Submissions (Reviews, Photos, Messages)

When you submit a review, photo, or message, you grant LUMINA a non-exclusive, worldwide, royalty-free license to use, display, edit for clarity or length, and distribute that content in connection with our products and marketing. You represent that the content is yours, accurate, and does not infringe anyone else's rights. We may remove submissions for any reason.

Disclaimer of Warranties

The site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site will be uninterrupted or error-free, that defects will be corrected, or that the site is free of viruses or other harmful components.

Individual results from cosmetic skincare vary. We make no guarantee that any product will produce a specific result for you.

Limitation of Liability

To the fullest extent permitted by law, LUMINA's total liability for any claim arising out of or relating to the site or a product is limited to the amount you paid for the product that is the subject of the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages, even if advised of the possibility. Some jurisdictions do not allow these limitations, in which case they apply to the maximum extent permitted.

Indemnification

You agree to indemnify and hold harmless LUMINA, its owners, and its agents from any claim or demand (including reasonable attorneys' fees) arising out of your breach of these Terms or your misuse of the site or products.

Governing Law & Disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. The exclusive venue for any dispute is the state or federal courts located in Houston, TX, and you consent to personal jurisdiction there. Nothing in these Terms limits any non-waivable rights you have under the consumer protection laws of your home jurisdiction.

Changes to These Terms

We may update these Terms from time to time. The "Last updated" date will reflect when changes take effect. Continued use of the site after a change means you accept the updated Terms.
